Olivier Martinez’s temporary restraining order against Halle Berry was extended through the weekend as their custody fight over alleged abuse of their teenage son entered a fifth day of closed hearings in Los Angeles.

The divorced couple returned Friday to Stanley Mosk Courthouse for another round of sealed testimony in a case that has already limited Berry’s time with their 13-year-old son, Maceo, and shows no sign of wrapping up quickly.

Page Six reported that court adjourned at 4:30 p.m. and that the temporary domestic violence restraining order will remain in place at least through the weekend, with hearings set to resume Monday.

Martinez presses abuse claims behind closed doors

Martinez, 60, has alleged that Berry choked Maceo during a confrontation at her home on Sept. 26 and that the boy later reached out asking to be picked up. He has also claimed ongoing abusive behavior by the Oscar-winning actress toward their son.

A judge previously granted Martinez the temporary restraining order and his request for primary custody. That arrangement has restricted Berry’s access to Maceo while the case proceeds.

Berry, also 60, has denied the allegations. She has asked the court to dismiss the restraining order, restore 50/50 physical custody, and award her sole legal custody. Her attorneys have called Martinez’s claims baseless.

Berry’s lawyer, Marina Beck, previously told Page Six that Martinez’s accusations were “entirely meritless and deliberately misleading.”

"entirely meritless and deliberately misleading"

Beck has stressed that her client vigorously denies any wrongdoing.

Prior sworn statement under sharp attack

On Thursday, the fourth day of hearings, Beck cross-examined Martinez about a sworn declaration he signed under penalty of perjury on Sept. 30, 2024. In that filing, described in court, Martinez stated the former couple had no history of domestic violence.

Beck pressed him on the point.

"That statement was true when you made it on September 30th, 2024, correct?"

Martinez answered: “correct.”

His lawyer, Patrick Baghdaserians, later explained the context to Page Six, saying the 2024 statement involved a request for need-based attorneys’ fees, not custody, and that it remained accurate on the facts as they stood then.

"There was no conviction of domestic violence at the time so his statement is correct. At the time there was no restraining order ever requested, ever entered. So the statement, it’s correct. There is no history of domestic violence restraining orders. But again, that is not for anything related to custody, it’s for need-based attorneys fees."

In short, Martinez’s camp draws a hard line between the absence of prior court findings and the new allegations now before the judge. Berry’s side treats the earlier sworn denial as a credibility problem.

Teen son already spent hours on the stand

Maceo spent upwards of four hours testifying earlier this week in closed-door proceedings. Berry herself testified Thursday about her son. The substance of that sealed testimony has not been made public.

Friday brought more closed-door testimony from Martinez, who continued to press his claims. After the lunch break, Berry’s fiancé, musician Van Hunt, 56, took the stand. Hunt left the courtroom alone around 4 p.m. He was later seen laughing with a member of Berry’s legal team; Berry was observed rubbing his arm in the hallway outside the courtroom.

Martinez exited with his attorneys after the 4:30 p.m. adjournment.

Daughter expected to testify Monday

Hearings resume Monday. Berry’s 18-year-old daughter, Nahla Aubry, is expected to testify virtually. Nahla previously submitted a court declaration stating she had never seen Berry abuse Maceo.

Berry’s legal team has also filed documents alleging that Martinez meddled with Maceo’s education and therapy and pulled the teenager into the middle of the adult dispute. Full texts of those filings were not detailed in the reporting.

Long breakup, high-stakes custody math

Martinez and Berry married in a private ceremony in 2013 and welcomed Maceo the same year. They separated in 2015. After years of legal wrangling, the divorce appeared to settle in 2023. Under that arrangement, Berry was ordered to pay Martinez $8,000 a month in child support.

What began as a settled co-parenting setup has now become a full-scale custody fight built on domestic violence allegations, a temporary restraining order, and days of sealed testimony from the parents, the child, and people close to the household.

No findings of fact, credibility rulings, or permanent orders beyond the weekend extension of the restraining order were reported from Friday’s session. The judge has not publicly resolved whether the Sept. 26 choking allegation or the broader pattern claims are proven.

When a teenager spends hours on a closed witness stand and a restraining order keeps getting renewed, the court’s first job is clear: protect the child, test the evidence, and stop treating custody like another Hollywood press cycle.
