Democrat-appointed MI judge dismisses 'fake electors' case against Trump supporters

In a stunning rebuke of progressive overreach, a Michigan judge tossed out charges against 15 Republicans accused of acting as fake electors on behalf of Donald Trump in 2020, as the Daily Mail reports. The ruling, delivered by a Democrat-appointed judge, signals a rare victory for constitutional rights over prosecutorial zeal. It’s a sharp reminder that not every Trump supporter is a criminal mastermind, despite what the left might claim.

Judge Kristen Simmons, appointed by Michigan Democrat Gov. Gretchen Whitmer, dismissed the case against 15 Republicans accused of falsely certifying Trump’s 2020 election win. These defendants, including former Michigan GOP co-chair Meshawn Maddock, maintained their innocence throughout the ordeal.

Following Trump’s loss to Joe Biden in 2020, several of his supporters signed documents claiming they were casting Michigan’s electoral votes for him anyway. Those documents landed at the National Archives and fueled arguments against certifying the election on Jan. 6, 2021. The left called it fraud; the defendants called it free speech.

Judge rejects prosecutor's narrative

“I believe they were executing their constitutional right to seek redress,” Judge Simmons wrote in her ruling. That’s a polite way of saying the prosecution’s case was a house of cards. The judge saw through the narrative that these Republicans were scheming masterminds.

Simmons noted the defendants “seriously believed” there were irregularities in the 2020 election. Their actions, she argued, stemmed from genuine concern, not criminal intent. This dismantles the left’s obsession with painting every Trump ally as a villain.

The prosecution, led by Michigan Attorney General Dana Nessel, charged the group in 2023 with forgery and election law violations. One defendant cut a deal to cooperate, leaving 15 to face the music. Nessel’s team, however, fumbled the ball spectacularly.

Sophistication, intent found lacking

“The document that was presented doesn’t even align with the level of sophistication that the prosecution wanted the court to believe,” Simmons stated. In other words, these weren’t exactly Ocean’s Eleven-level operatives. The judge called out the prosecution for overhyping the defendants’ capabilities.

Simmons ruled that the prosecution failed to prove criminal intent. The defendants lacked the “sophistication” to orchestrate the complex scheme Nessel alleged. This is what happens when you stretch a case to fit a political agenda.

Nessel, undeterred, doubled down outside the courthouse. “The evidence was clear: They lied. They knew they lied, and they tried to steal the votes of millions of Michiganders,” she said. Sounds like sour grapes from a prosecutor who couldn’t make her case stick.

Nessel’s defiance rings hollow

Nessel’s follow-up jab, “And if they can get away with this, well, what can they get away with next?” reeks of fearmongering. It’s the kind of rhetoric you’d expect from someone more interested in headlines than justice. The judge’s ruling begs to differ.

This victory for Trump’s allies is a rare moment of clarity in a justice system often weaponized against conservatives. The defendants, ordinary citizens with genuine concerns, were exercising their rights, not plotting a coup. The woke crusade to criminalize dissent took a hit here.

While Michigan’s case has collapsed, other states are still pursuing similar charges. A Wisconsin judge recently refused to dismiss charges against three individuals accused of being fake electors. The battle over 2020’s fallout is far from over.

A win for free speech

Tuesday’s ruling is a win for those who believe citizens can question elections without facing jail time. The left’s rush to label every Trump supporter a threat to democracy just got a reality check. Simmons’ decision shows that even Democrats can see through the hysteria.

The prosecution’s failure in Michigan exposes the fragility of politically motivated cases. Nessel’s team couldn’t prove intent, and their “sophisticated conspiracy” narrative fell apart under scrutiny. It’s a lesson in overplaying your hand.

For now, these 15 Republicans can breathe easier, vindicated by a judge who prioritized facts over feelings. But with cases lingering in states like Wisconsin, the fight for electoral integrity -- and the right to question it -- continues. The left won’t stop, but neither will Trump’s allies.
