Alina Habba, the fierce Jersey girl and loyal Trump ally, has just resigned from her post as the interim U.S. Attorney for the District of New Jersey after a bruising legal battle.
After a whirlwind of courtroom defeats and a unanimous ruling against her by a federal appeals court, Habba’s tenure as Acting U.S. Attorney came to an abrupt end, though she’s not leaving the fight entirely as she transitions to a new role within the Department of Justice, as the Daily Mail reports.
Let’s rewind a bit to understand how we got here. Habba, a steadfast attorney for Donald Trump during his legal skirmishes between presidential terms, later joined his campaign as a senior advisor. Her loyalty and grit made her a natural pick for bigger roles.
After moving to Washington, D.C., to serve as Counselor to the President, Habba soon felt the pull of home. She expressed a longing to return to New Jersey, where her husband and children reside, prompting Trump to nominate her for the U.S. Attorney position in her home state.
Trump installed her as interim U.S. Attorney for a 120-day stint, a move that seemed like a homecoming win. But the Senate wasn’t buying what Trump was selling—her nomination proved too contentious for a confirmation hearing.
Controversy swirled as legal challenges mounted against her temporary role. A series of court losses began to pile up, questioning the legitimacy of her acting status.
Trump’s Department of Justice tried to play hardball, overriding the selection of her replacement by a panel of judges and reinstalling Habba as Acting U.S. Attorney. That move, however, was later deemed unlawful by the courts, putting her position on shaky ground.
On Dec. 1, the U.S. Court of Appeals for the Third Circuit delivered the final blow. A three-judge panel unanimously upheld a lower court’s ruling that Habba was unlawfully serving in the role, effectively disqualifying her pending any further appeal.

Habba herself announced her resignation, framing it as a necessary step for the greater good. “As a result of the Third Circuit’s ruling, and to protect the stability and integrity of the office which I love, I have decided to step down in my role as the U.S. Attorney for the District of New Jersey,” she stated.
