New York City health officials identified Legionella bacteria in the water-cooling towers of 31 Upper East Side buildings, among them the Guggenheim Museum, which draws roughly 1,100 visitors a day, as a Legionnaires' disease outbreak that began July 2 has now sickened at least 46 people and left 22 hospitalized.
The city Department of Health released the full list of infected addresses on Friday, the New York Post reported. Twelve of the 31 buildings were ordered to complete deep cleaning by Saturday. Whether all twelve met that deadline remains unclear.
The numbers have climbed fast. AP News reported that as of July 6, just four days into the outbreak, there were 23 confirmed cases and 17 hospitalizations in the Carnegie Hill and Yorkville neighborhoods. Five days later, the case count had doubled to 46. No deaths have been reported, but the trajectory raises a straightforward question: Who was minding the cooling towers before the bacteria spread?
The DOH's own inspection records supply part of the answer. More than half of the neighborhood's cooling towers had already been cited by health officials during their most recent inspections, including for failing to perform regular monitoring and cleaning and for failing to submit Legionella test results to the health department as required by law.
That is not a freak accident. That is a pattern of non-compliance that city inspectors documented and, by all appearances, failed to enforce aggressively enough to prevent what came next.
Since July 2, the DOH has tested 183 cooling towers across the Upper East Side. The screening uses a polymerase chain reaction (PCR) test, which detects the presence of Legionella DNA but cannot determine whether the bacteria are alive or dead. Only live bacteria can cause illness. Test results take roughly two weeks to return, meaning the city is still working with incomplete information even as the outbreak grows.
The Guggenheim Museum, located at 1071 Fifth Ave., was among the 19 properties that had already cleaned and disinfected their tainted cooling towers by the time the DOH released its list. A museum spokesperson told the Post on Saturday:
"The city has confirmed that there is no additional action needed at this time, and this poses no risk to anyone inside the building."
The spokesperson added:
"The safety of our staff and the public are the utmost priority, and we are continuing to follow all city guidelines."
The museum was not ordered to shut down at any point. But the Post noted that the Guggenheim declined to say whether it had reached out to patrons who may have visited during the period when Legionella was present in its cooling system. For a venue averaging more than a thousand visitors daily, that silence is worth noting.
Legionnaires' disease is a severe form of pneumonia caused by Legionella bacteria that grow in warm water. Contaminated cooling towers can aerosolize the bacteria into tiny water droplets, which people inhale. The disease does not spread person to person. Drinking water and residential air conditioners are not the source, health officials have emphasized.
Symptoms, cough, fever, shortness of breath, muscle aches, headaches, can appear anywhere from two to 14 days after exposure, Fox News reported. Those over 50, smokers, and people with chronic lung conditions face the highest risk.
NYC Health Commissioner Dr. Alister Martin told reporters the disease "is deadly but can be effectively treated if diagnosed early." Dr. Nathan Goodyear, an integrative medicine expert, stressed that "treatment needs to be early and aggressive" because Legionella causes an intracellular infection requiring antibiotics.
Newsmax reported that Commissioner Martin expressed confidence the source was a cooling tower. "We're pretty confident that this is coming from a cooling tower," he said. "Your water is safe. Your air conditioners are safe."
The DOH's list spans addresses from East 78th Street to East 95th Street, running across Fifth Avenue, Third Avenue, Second Avenue, York Avenue, and East End Avenue. The outbreak is concentrated in three ZIP codes: 10028, 10128, and 10075.
Among the 31 addresses: 180 East End Ave., 1750 York Ave., 1438 Third Ave., 1551 Third Ave., 1080 Fifth Ave., 1001 Fifth Ave., 240 E. 82nd St., 8 E. 83rd St., 145 E. 84th St., 117 E. 85th St., 501 E. 87th St., 333 E. 91st St., 354 E. 91st St., and 312 E. 95th St., along with more than a dozen others scattered across the neighborhood.
Nineteen of those properties, including the Guggenheim, had already cleaned and disinfected their cooling towers by the time the list went public. The remaining 12 were given until Saturday to finish. The DOH said its investigation would continue through the weekend and that more buildings could be added.
The city issued a blanket warning in late June, before the outbreak was even formally declared, urging anyone who lives, works, or has visited the infected neighborhood since that time to contact a health care provider immediately if flu-like symptoms develop. That warning has only grown more urgent as the case count has risen.
But the real story is upstream of the warning. New York City requires building owners to test, treat, and report on their cooling towers. More than half the towers in this neighborhood had already been flagged for failing to do so. The inspections happened. The citations were issued. And 46 people got sick anyway.
The DOH has not identified which specific building or buildings are the source of the outbreak. The PCR tests that flagged the 31 properties cannot distinguish between live bacteria capable of causing illness and dead bacteria that pose no threat. More precise results are still weeks away.
Meanwhile, the investigation is open-ended. The city has not confirmed how many of the 46 diagnosed individuals have been discharged. It has not disclosed the precise date range during which each building's cooling system harbored the bacteria. And it has not said whether the building owners who were cited for non-compliance before the outbreak face any additional enforcement action now.
New York has seen Legionnaires' outbreaks before. The cycle is familiar: bacteria grow, people get sick, the city tests and cleans, officials reassure the public, and the underlying enforcement gap that allowed the problem to fester goes largely unaddressed until the next cluster.
The cooling-tower maintenance rules exist. The inspection apparatus exists. The citation authority exists. What appears to be missing is the follow-through that turns a citation into actual compliance before residents and visitors start showing up in emergency rooms.
Forty-six cases and counting. Twenty-two people still in hospital beds. And more than half the cooling towers in the affected area had already been told they were out of compliance. At some point, a warning that nobody enforces stops being a warning and starts being paperwork.
